Which States Have Legalized Magic Mushrooms And Where The Movement Is Going

What Are Magic Mushrooms?
Magic mushrooms, also known as psilocybin mushrooms, are a type of mushroom that contain the psychoactive compound psilocybin. Psilocybin is a naturally occurring substance that can produce altered states of consciousness, including hallucinations and changes in perception.
Legal Status of Magic Mushrooms in the United States
As of October 2026, psilocybin is still a Schedule I controlled substance under federal law, so possessing, selling, or shipping magic mushrooms remains federally illegal. At the state level, though, the picture has changed a lot since 2020. A handful of states have created regulated psilocybin programs, and dozens of cities have made enforcement against personal use a low priority. None of these programs allow traditional retail sales like cannabis dispensaries.
States Where Psilocybin Is Legal or Regulated in 2026
These are the states with programs written into law as of October 2026:
- Oregon: the first state to legalize supervised psilocybin use, through Measure 109 (2020). Licensed service centers opened in 2023. Adults 21 and older can use psilocybin at a licensed center with a trained facilitator, and no prescription is needed. Take-home sales are not allowed.
- Colorado: voters passed Proposition 122, the Natural Medicine Health Act, in 2022. It decriminalized personal possession and growing for adults 21 and older, and licensed healing centers began serving clients in 2025.
- New Mexico: the Medical Psilocybin Act (Senate Bill 219) was signed in April 2025. It creates a medical program for qualifying conditions, with patient access expected to begin between late 2026 and 2027.
Decriminalized, not legal: Washington, D.C. (Initiative 81, 2020) and cities such as Denver, Oakland, Santa Cruz, Seattle, Detroit, and Ann Arbor have made enforcement against adult personal use a low priority. That is different from legalization. Selling mushrooms is still illegal in these places, and state and federal law still apply.
California has not legalized psilocybin. A 2023 bill to decriminalize it (SB 58) was vetoed, and newer proposals are still being debated.
The Growing Movement Toward Legalization
Momentum is mixed. Oregon and Colorado passed their programs by ballot measure, but Massachusetts voters rejected a similar measure (Question 4) in November 2024. Most new activity is now in state legislatures. Lawmakers are proposing supervised therapy programs, research pilots, and "trigger" laws that would allow medical access automatically if the FDA approves a psilocybin treatment. No state allows recreational retail sales of magic mushrooms.
Looking Ahead: The Future of Legalization
The biggest thing to watch in 2027 is the FDA. Psilocybin therapy has finished late-stage clinical trials, and a drug application is expected. If the FDA approves it, federal rescheduling and state trigger laws could follow. For businesses, the practical takeaway is that rules are set state by state and change often. Programs like Oregon's and Colorado's come with their own packaging and labeling requirements, so check your state regulator's current rules before you package or sell anything.
